    Default Injured Helping Landlord

    My question involves landlord-tenant law in the State of: Arizona

    I have been renting a house in Mesa AZ for 4 years. In the four years there has been 2 different owners and 3 different managers.
    It has been a wonderful place to live until the new owner took over. Part of the lease agreement is that I take care of lawn maintenance.
    Last year the irrigation broke in our front yard and was leaking into the neighbors yard. I happened to be out of state and my wife was at home when this happened. I called the landlord and he yelled at me for no reason and told me it was my responsibility. I had our lawn care service repair it and it cost $400 they had to replace all the lines in the front yard due to wear. I didn't want to be yelled at again so I are it.
    The same thing happened again only I happen to be home. I called the landlord and yelled at me and he told me it was an easy repair. I told him about how the previous it cost a lot of money and they had to dig up the entire front yard. He yelled at me more and said he bent over backwards for me. I felt like I was going to lose my temper and gave the phone to my wife. He then yelled at her and told her we can move. His wife then took the phone and cooled things off for us.they said the called a repair guy and he would be over to fix it. They sent the parts to us for the guy to fix it or he would give me $20 to do it myself. He never showed and our palm trees were dying . The following Saturday I spent an hour digging up line and found out the hoses he sent me were the wrong size. I called him and he said he would send his guy out to fix it.
    The following Wednesday I received a call at 8 am from the person who was coming to fix the irrigation system. He said he would be over in the afternoon. No one showed up and at 530 pm i was fixing dinner for my family the landlord was at my door. Now he happen to have my next door neighbor with him who he didn't know. My neighbor has went beyond being friendly and in the past had thrown beer cans over the fence in the yard as they always have loud parties which I wouldn't mind but I have small children. Well we went back and looked and the the neighbor said he would help anytime if the landlord gave him $20 for beer. So they exchanged numbers and the neighbor left. As we waited for the repair guy the landlord was real pushy and told me to dig the line up more. I was frustrated,mad and defeated. I started digging into the hard packed Arizona clay with a spade shovel. I got the trench all dug and the repair guy finally showed up at 6pm. The land lord left and the repair guy was there until around 8pm struggling to get everything fixed. So when I went to bed that night I noticed my right testicle was a little sore and each day after it has hurt worse and now I have been laid up all weekend in pain. I know it was from shoveling and I felt I was bullied into the position buy bring my neighbor over and saying how easy it was to fix. I think I am going to have to go to doctor tomorrow and with health insurance the way it is I already can see this is going to cost me $200 or more. Am I responsible for this? We also now want out of our lease. We have paid $1400 rent on time every month for 4 years as well as good references from the previous owners and managers. I'm sorry for the long story but I felt it was need to fully understand our situation. Thanks

    If you have a month to month tenancy it is relatively easy to terminate such a lease. Do a little research on what this takes; for most states a 30 day written notice to the landlord that you wish to terminate such a lease. No reason for terminating the lease need be providing.

    If you have a longer lease, you need to read it to see if there is a "buy out" clause in the lease (i.e., a method of buying yourself out the lease early) or if you can perhaps sublease (finding someone to take over your lease) should you wish to terminate it.

    First of all, nobody held a gun to your head. You did the work voluntarily so if you got hurt that's on you.

    Frankly, you should have read your lease contract before agreeing to pay for any repairs to the landlord's property.

    You would have likely found that you have no responsibility for repairs to plumbing, fixtures and equipment due to wear and tear or malfunction through no fault of your own.

    You should also read the Arizona Residential Landlord Tenant Act, Chapter 10:

    Even now you might be able to recover the money you paid for the repairs that the landlord should have made.

    But, sorry, nothing for the injury. Had you known better, you should have just refused to handle or pay for the repairs. Unfortunate that you succumbed to some jerk yelling at you.
