    Default Garnishment / Equity in Marital Home

    Im going through a divorce right now and my soon to be ex thinks there is alot of equity in the house. To keep the house I had to sell the house to my mother, I didnt make her pay the closing cost, I paid those, so I only received a check for approx $6800 which paid for some more closing cost and i had to get a new car, I am giving my ex the car which is worth approx $4000. my soon to be ex wants 1/2 of the equity. He told me if i didnt pay then my wages would be garnished, is this true?

    The larger question is whether your mother paid fair market value for the house. If you sold her the house at below market value, and the court assesses a higher market value, he may be entitled to equity based upon the appraised value of the home as opposed to the sale price.

    It is somewhat unusual for wages to be garnished at the conclusion of a divorce case, but if the law allows it, it is not outside the realm of possibility.
