    Default Regulation of Garage Rented for Storage to a Non-Residential Tenant

    My question involves real estate located in the State of:California
    City of Santa Monica California.
    I rented a small garage in the back of a residence for storage of some furniture. Are there any regulatory standards that an owner must meet for these kinds of rentals. The unit is now over run by rats which have ruined several items I've stored. What is my recourse?

    You can check with your local government to verify if the rental was consistent with the manner in which the residence is zoned.

    As a general rule, even in a residential tenancy the landlord is only going to be responsible for the presence of rodents after their presence is brought to the landlord's attention and the landlord has had a reasonable amount of time to implement pest control.

    Part of the answer depends on whether or not you have a written rental agreement that says who's responsible for what.

    However, in the absence of a written agreement, if you were given exclusive use of the garage and allowed to secure it without the owner having access then I don't think you have any recourse because it would have been completely up to you to monitor and protect your belongings.

    Even if the owner had a key for emergencies it still might work that way.

    And you still might have to hire your own exterminator.
