    Default Can You Still Be Charged With a Crime if the Police Didn't Come to the Store

    Hi I was caught shoplifting $67 worth of merchandise from Walmart today in Texas. I was taken into a little office for questioning and they asked for my id and social security number. They called the police but they never showed up, so the Walmart employees let me go with a letter that says "the incident in which you were involved may have implications beyond criminal charges. In addition to criminal penalties, state statute allows retailers to recover civil damages/penalties as a result of such events. A written notifical explainng the civil remedy that is being sought may be sent to you by the law offices. If you receive such a notification, please respond promptly as they act on behalf of walmart."

    And at the bottom it says "this notification is for informational purposes only and is not a release from criminal prosecution, nor does it negate trespass warnings issued by walmart."

    Can I still be charged with a misdemeanor B even though police were not involved? Please let me know.

    Yes, of course you can still be charged with the crime you committed.

    It is possible that the police arrived after you were released and took a report. If so, that report will be forwarded to a prosecutor for charges. Or, maybe WallyWorld never reported it at all. Keep an eye on the mail and watch for a summons or notification of warrant…you'll just have to wait and see.
