    Default How to Evict Your Tenant From a Manufactured Home

    My question involves landlord-tenant law in the State of: Michigan
    Here is my situation. I live in a mobile home that I own and have a lease agreement with the trailer park. The guy that has lived here (as a roomie i guess you could say) for about five years has become more of a problem than you could imagine and needs to go. We have no lease agreement and he does pay the rent on time (to me) but that is not the reason that he needs to go. It is the fact that he does not care about anything and is doing everything that he can it seems to slowly destroy the place. I need some advice here. What do I do?

    That's easy.

    He's your tenant, not the park's tenant.

    He's a tenant at will.

    All you need to do is give him written notice that you are terminating his tenancy and he needs to move out by such and such a date.

    See Michigan statute 554.134:

    For example, if his rent is due 6/1, on 6/1 he pays his rent and you hand him written notice that his tenancy terminates on 7/1.

    You don't need to state a reason for a termination of an "at will" tenancy.

    Michigan requires notice to quit of one full rental period. Unless required by the lease, that notice period does not have to encompass a full rental period, such that notice given on (for example) the 8th of the month would be effective one month later. ("The notice terminates the tenancy at the end of a period equal in length to the interval between times of payment.")

    True. That's in there. But I don't recommend that method. Too easy for the tenant to just not pay on the next due date or get into arguments about pro-ration or security deposit.

    Experience talking.

    Much cleaner to stick it out till the rent's due, collect it and give one month from there.
