    Unhappy Fired During Pregnancy

    My question involves workers compensation law for the state of: California

    Hello ,
    Im asking for advice for my situation. I have been working for a small office since Nov of 2014. I have never been late,missed work for doc apts, No wright up's and I never made any mistakes that would cost me my job. I was let go today because my boss gave me a ultimatum he knows I couldn't take. He changed the daily hours Forcing me to say NO ,he gave me my last paycheck. I'm almost 6 months pregnant and need to know if California has any compensation laws or anything for women in my situation. Being this far along is going to be a struggle to find another job. I worked PT and I have the original e-mail when he hired me to be PT. I have another PT job that he was fully aware of before I accepted his offer back in Nov.

    any information would be greatly appreciated .

    I don't mean to sound cold, but what makes your situation any different from anyone else who is let go under such circumstances?

    Absent a collective bargaining agreement or other contractual obligation, your boss could have let you go because the sky is blue, and he was pissed that you couldn't make it purple.

    You need to apply for UI.

    Did you bring the pregnancy into the discussion because you're wondering how it might affect unemployment eligibility, or did you bring it into the discussion because you believe your firing was pretextual and somehow relates to your pregnancy? If the latter, do you have any evidence to support your suspicion?

    Since the reason she could not work the new changed hours sounds like it was because she has another part time job, it may be tricky for her to qualify for unemployment benefits. Even if she has enough wages in the previous five quarters to set up a claim, she won't be able to draw unemployment unless she is making less on her other part time job, in gross wages, each calendar week (Saturday through Sunday) than she could draw weekly in benefits if approved. And then of course, it would go into availability for an equivalent job, is sort of hard not to restrict the days hours and shifts you'd be available to work. But no matter what, it doesn't hurt to file, regardless, and should be the first step, even if you think you have some other kind of case against the employer who has de facto gotten rid of you.
