My question involves labor and employment law for the state of: Ohio
My question is related to a restrictive covenant and whether it is still valid or not. I started working for my current employer in 2000 under a 1 year employment contract. For the first 5 years, on my anniversary date, I would be presented with a new 1 year contract. Starting in 2006 and for the next few years I would get my new contract anywhere from a week to a month after my anniversary date - mainly because it's a small firm and my anniversary date fell in the middle of our busiest time. In 2010 we had our busiest year and getting my new contract was kind of put on the back burner. This wasn't an issue for me because other than an occasional small salary bump my contracts were always pretty much the same year to year except for a date change. It's been the same situation every year since. Therefore the last 1 year contract I signed was in 2009.
I'm getting ready to make a change but stay in the same field and some of the restrictions may have an impact on where and what I do next. I'm not questioning any of the restrictions - I agreed to them. I'm questioning whether they are still valid or not. What I'd like to know is have I been essentially working under the terms of the 2009 contract which I'm still bound to, or have I been working without a contract the last 5 years?
The only thing the 2009 contract states with regards to the contract expiring is in the Term of Employment:
"The term of the Employee's employment shall commence on the 1st day of June, 2009 and shall continue for a period of one year until the 1st day of June, 2010. Due to the nature of the employer's schedule and workload, they reserve the right to extend the length of the contract up to 2 weeks to allow completion of an updated contract for the following year."
