    Default Can You Get Emancipated if a Parent Wants You Out of the House

    I'm looking into Emancipation. My father, has been abusing me for years, went to jail for it. A couple months ago, he started kicking me out. Made me leave for no reason, I'm 15 years old. He wants me out of the house. I'm trying to find different alternatives. But I can't. I'm starting homeschooling. And I have a job. If he argees to me being emancipated, does that mean I can be?

    That would be a no. No state anywhere, even though you failed to mention yours as required....

    will emancipate a 15 year old. However, since you're being abused and have been told to leave the house, call CPS so they can find suitable placement for you.

    The state is very important, actually because there is at least one state, California, that does permit emancipation of minors as young as 14. See California Family Code § 7210. There might be a few others that allow minors under 16 to petition for emancipation, too, though not I’ve researched every state to know if that’s the case.

    The last time I checked (and I have) California was the only one. Louisiana used to, but they've changed their laws and 16 is now the minimum.

    Even in CA, unless the 15 year old minor has the means to support herself while still going to school, emancipation is unlikely at best. The state is not inclined to emancipate a child to become dependent on the taxpayers.

    True, that’s a basic requirement in every state for emancipation of a minor. If they cannot support themselves they cannot succeed in an emancipation proceeding.
