    Default How to Remove Fire Protection Board Members

    I am a volunteer fire fighter for a department in Missouri. Two of our board of directors and chief are not representing the department in a way that is best for the community and hasn't for many years, we have money in the bank worth of tax payers money and possibly more that should be used to help better the department so that we can better support our community. The tax payers are suffering because of our board of directors and Chief... Myself and another firefighter was thinking about doing was getting a petition together to have the board and our chief removed from there positions and have the community vote for a new board of directors. They are trying to run the department like they want and are not taking into the fact that they are hurting our community. They question us and protest us anytime we ask for a new piece of equipment that they know will help others but just cant get past spending the money that is given to us for that reason. There is so much more and way too much for me to sit here and type. My question is, is this petition legal. Also the fire chief is voted in by the board so can we have him removed with using the petition? The biggest thing that gets us is that the community doesn't know how bad the department is ran by the people they elect, they don't know the real truth.

    With respect to the board members, the simplest way is to start a recall drive and if you get enought signatures on a recall petition, an election will be held to recall the board members and name replacements.

    Replacing the Chief will depend on whether he is an "at will" employee or has civil service protection.

    A word of caution - No matter who is in charge, there will always be people who disagree philosophically with their stewardship. Unless you can point to actual misconduct by the board and Chief, such as serious violations of the law or district policy, most folks will just look at your effort to oust the current leadership as coming from a bunch of malcontents.

    You also have to consider that their perspective is different from yours. You may see the need for a particular piece of equipment but do not understand (or have not been informed) of the costs, maintenance, training, or other strings or ongoing expenses that might be attached to such a purpose. I see it a lot from line level police officers. They advocate for equipment but do not quite understand that the issue about more than merely the purchase of the equipment. If you cannot use it for other reasons (training, supplies to operate it, ongoing maintenance, etc.) then it may not be a good idea to get it.

    Now, this could be an example of petty egos elected to the board, or, it could be that your side and theirs have a poor line of communication.

    And if the board's actions are actually doing harm, then maybe you and your fellows should consider educating the public. Or, advocating for action at the open sessions. If you are not attending the meetings and letting your position be known and actually engaging the board in a discussion, then you are not availing yourself of the opportunity to make a change.
