    Default Management took property for Water Bill

    MBS took television sets yesterday from numerous residents in Texas for delinquent water bills (In some cases 52" televisions for $30-45 bills). This is not legal. Liens are allowed in the lease for delinquent RENT, not water. This is a violation of the Texas Property Code as well as a violation of the Water Code, who should I contact regarding the Water Code violation?

    Default MBS Landlord's Lien in Texas

    The property that I live at (an MBS property), enforced a landlord's lien on my property for a delinquent - water - bill. In one other resident's case a 52" TV for a $30.00 bill!

    Liens are not legal in Texas for delinquent water bills - only rent (It states this can be done for "delinquent rent" in the lease agreement and the Property Code). However, when I call, they tell me that my water is late. Can anyone see the theft that is going on, or is it just me?

    Also, it doesn't state anywhere that I have to provide two separate money orders for rent and water. For some reason, they are not accepting my rent until I get a refund of the Money Order and have two separate ones issued. They take both payments in one MO from other tenants though....
