    Default How to Dispose of Abandoned Property in a House Purchased from the County

    My question involves personal property located in the State of: Nevada

    The County I live in took deed of a property in July 2014. The property was abandoned in 2012 and it appears as if they left with only the shirt on their back. Dishes in sink, food in fridge, clothes in washer, garbage everywhere...and no power or water for the last 3 years. The County did a 1 year redemption period for unpaid taxes and then they took possession and deed.
    I plan on bidding on this house in a County auction this week and need to know how I can sell the personal property that was left behind in 2012 if I am the highest bidder. There is a Ford explorer in the driveway, all the furniture,....... I know that I would have to give notice to previous owners and publish it in the newspaper but, I need more details for Nevada law as the NRS is complicated. The previous owners of the property, one is deceased and the other is in a nursing home. It was their son who was living there and left all his belongings. The County is telling me that they are auctioning off the house and property and what is there as far as personal property, they consider that abandoned since they gave the previous owners a 1 year redemption period.

    There are two different issues here. The first is the personal property. You need to notify the son that you are disposing of the property.
    The abandoned vehicle is covered by a different statute. Getting rid of that is a common task for towing companies. Note that neither gives you rights to income from the property over and above what you are owed by the owner (or costs in storage and removal of the property).

    The Ford Explorer may not be something that you can "buy". You may just have to have it hauled off. As far as the rest of the stuff is concerned, you can dispose of it how you like.

    If there are personal/family items that might have significance you might consider putting an ad in a local paper to see if any relatives come forward. I would do that myself, only because I wouldn't want family photos or other momentos to be lost.

    I would suggest a brief consultation with a local real estate lawyer. Your state's statutes and case law are relatively thin, which can in some contexts be a good thing but which here presents some difficulty in pointing you to any legal authority beyond your state's abandoned property laws. In a typical state, as llworking suggests, the buyer under such circumstances would be entitled to view the personal property left behind as having been discarded, and to dispose of (or salvage from) the items as they see fit; but I don't see authority for your state.

    For removal of abandoned vehicles from private property, see NRS Sec. 487.230, et seq.

    Do I need to notify the son even if I purchased the property from the County and not him or his family? What if I can't locate him, can I do a publication in the local newspaper and give a deadline of when he would need to get his belongings out? The second issue of the car, if it is good condition could I do the notification and then get an abandoned vehicle title and sell it and put that cost toward the storage of belongings and the hundreds of dollars I am going to have in landfill fees for the garbage that they left?

    I don't see anything in the NRS that gives a hoot how you obtained the property. The notice can be sent to the "last known address."
    Yes, the proceeds of the sale can be used to defray your costs of disposing of the property.

    Again, "I would suggest a brief consultation with a local real estate lawyer." Your state's abandoned property laws are an awkward fit for your needs, and you may not be restricted by them.
