    Default First Right of Refusal on the Marital Home

    My question involves civil rights in the State of: MA

    My ex husband was granted first right of refusal on my house when we got divorced if I were to remarry or when my youngest son turns 18. At the time of our divorce I bought him out and refinanced the house in just my name. I am now remarried, but before I got married he signed away his first right of refusal. He now thinks that he still has the option to purchase the house from me when my son turns 18. Is this correct? Does he now get another opportunity to take the house even though he signed the paperwork and it was filed with the lawyer?

    You still might have to give him right of first refusal if you actually decide to sell the house, but its completely your property now and he cannot force you to sell the house. What right of first refusal means is that if you decide to sell, he has to be offered the chance to buy it before you sell it to anyone else. By all means consult the attorney who handled the paperwork, but you bought him out and that should have ended things.

    Never mind what's "filed with the lawyer" where are your copies of all your divorce documents?
