    Default Can a Recorded Conversation With the Other Parent Be Used in Court

    My question involves a child custody case from the state of: Indiana
    My son's dad is tryn to say that he's gonna take this convo and show the judge. But idk what would that solve? I copied the convo that we had thru txt message. Maybe someone here can tell me why he thinks the judge will care to see this
    Dad: Mason needs to get out of there. He should stay here until you get a place

    Mom: you put tht like I never try to get him an me In a dofferent place an ur probly going to tell thee judge like ive never try to get him an me in to a different place

    Dad: Nobody said you aren't trying to get Mason out of there. But you act more concerned with whether or not you'll get to see him everyday, when your main concern should be his wellbeing. It is not best for him to stay in a home with domestic violence/abuse. It affects him very poorly to be around that stuff.

    Mom: Nothing is wrong with our son

    Dad: Do you not really see how William's actions affects Mason?

    Mom: No because I dont let those things that u think happen which dont affect him

    Dad: Brittney they do to happen. You texted me just a week ago saying that William was trying to break your arm.

    Mom: But Mason didn't see it

    Dad: Mason can still hear what's going on. He has seen William hit you before. Just last October you said that William picked Mason up, you didn't want him to do that so you took Mason from William and William hit you because of it.

    Mom: Wow u actually rember that i figurd u would say something else

    Uh-huh. Don't worry about it. Just let the judge know that it is indeed you texting with Dad.

    You admit that your boyfriend is abusive. You admit that he abused you in some sort of tug-of-war involving the child. All of that is relevant. If you're honest in court, though, the use of the exchange would be unnecessary. It's only if you lie about what happened that it becomes necessary to impeach you with your prior, inconsistent statements and admissions.

    But he can prove that without this conversation. So why would he need this?

    I am really starting to think that this poster is actually dad or dad's girlfriend pretending to be mom. Nobody can be THAT CLUELESS for real.
