    Default Does Trading Services for a Room Create a Tenancy

    I have been living with some family members in Indiana for 10 months. We had a verbal agreement that included an exchange of a room to live in for me doing a bunch of home improvement projects. Can they just up and tell me to leave without any notice? I have personal belongings here, plenty of evidence to prove the work done, and also tons of witnesses.

    They can evict you as provided by Indiana law.

    My rent is paid though. I'm more curious about being given at least a 30 day notice or something.

    When you're essentially bartering your rent, there's a question of fact as to whether the rent is paid -- at some point the rent earned by your bartered services will have been exhausted. Do you have any form of written agreement or acknowledgment of how many months of rent you have earned through your labor?

    I have a tape recorded conversation from last week where they both stated it. I just wasn't sure if they can legally have a cop show up and start moving my belongings into the street.

    nothing beats a written contract,, its something that I myself have put into my rental contract and it basically states that any agreed work/repairs I do on the house gets knocked off my monthly rent, if your still on good terms you could write something up and get them to sign it, mine is basically a standard one year rent contract and we just hand written what I told you onto it at the bottom.

    ps,, you can find basic rental contract online and just print one up

    That's great advice Tony. Hindsight is 20/20. I didn't think I'd need one with family. And I don't think they would sign anything at this point anyway. My calculations and the numbers discussed for "rent" has me paid until late summer. They have their work done and don't need me anymore.

    A moderator must have changed the name of the thread. And that is exactly the legal question I guess I meant. Obviously, I wouldn't want to stay, but more concerned about having the proper time needed. Any recourse I may have afterwards is 2nd on my mind after securing my safety and belongings.
