    Default Can Grandparents Charge a Non-Custodial Father for Babysitting

    My question involves a marriage in the state of:New York

    Our daughter's divorce finalized 3 weeks ago. Two children 6 and 3. She has a part-time job. Until she can find suitable full-time employment they are living with me and my wife. Even though one is in kindergarten and the other occasionally goes to day care, we still spend considerable time babysitting them. Just to be clear, we love our grandchildren and our daughter, but don't think it's our job to provide free child care for her ex. He is required to pay 68% of child care expenses. Can we bill him for our services?

    Related question: If he doesn't abide by the conditions of the divorce agreement is there a way for us to bring it to the attention of the judge (or someone) without hiring a lawyer to do it?

    You are free to tell the father that you want to charge him a specified rate for taking care of the children during his parenting time. If he agrees to pay, then you can charge him the agreed rate. If he does not, then you can expect that he'll seek child care services elsewhere.

    If you have something of which your daughter is not aware that you believe is relevant to her custody case, tell her about it. It's up to her, whether or not she does anything with that information.

    I'm not talking about his parental time, but when my daughter is working during the week. His visitation is weekends only.

    Also, it would not be info. that my daughter is unaware of. We're just wondering if there's any way to address violations of the divorce agreement without paying a lawyer to do it.

    Would you be billing your daughter for the other 32% of the child care costs? As you've stated he's only responsible for 68%, therefore anything you charge, he would only be responsible for his percentage and your daughter would need to be able to prove shes paying her portion should he ever choose to fight it.

    Your daughter can try to collect reimbursement of his share of child care expenses based upon her actual proof of payment. You'll need to report your babysitting income to the IRS and pay taxes on that income.

    If your daughter believes that there is information that justifies asking the court to revisit some aspect of the custody case, she has the right to try to represent herself in bringing a motion before the court.
