Has anyone else been throught the following type of situation? If so, how did you deal with it?
My divorce took place in Davidson County in 1998 and was one of the first trial cases for the great "parenting plan". Mistake #1
Our son is currently 9 years old and lives every other week with his father in Davidson County and with me in a county adjacent to Davidson.
Each week that our child is in my care I drive to Davidson County twice a day in order to take my son to/from the public school system as agreed in the divorce decree. I follow the decree to the letter and have not broken any of my agreements.
The only agreement in the parenting plan my ex has not broken would be that he makes sure he physically has our child every other week.
The largest problem I have is that he leaves our 9 year old child who has been diagnosed with ADHD unsupervised regularly. This is a violation of Tennessee DHS regulations.
My ex has proceeded to quit his job that he had for the last 20 years and since April has not been employed. The excuse given to me is that he cannot find work that pays the same amount as his previous employer and best uses his MBA. Due to this he has voluntarily elected to cut my child support without a court agreement. The odd thing is how he still has the funds to buy a new truck for himself and furnish a house for his wife that just left him last month. How can you justify buying a hot tub for someone that just left you but fail to pay your child support?!?
He has also violated the parenting plan agreement in the following:
Provide health insurance until age 18
Provide 100,000 life insurance for a trust fund in case of death until age 18
Provide dental insurance until age 18
Outside of the obvious things I have just listed my ex has openly exposed our son to seeing him furnish minors with alchol, getting into a physical altercation with his stepdaughter's boyfriend, and the list goes on.
I have a great job but picked up additional odd jobs and started back to college in order to provide a better life for our child to ensure that he does not suffer from my ex's failure to do his part.
Is this what the legal system validates as fair and equal rights for all?!? If a train was going to hit a car would you try to save the people in the car before or after the accident if you had a choice?
