    Default Co-signer threats

    Our 31 year old daughter had to file bankruptcy in Connecticut with her husband who had $65,000 in CC debt hidden from her before marriage. He no longer works (fired and has not looked for a job for 3 years), but she works full time and makes good money. Her mother in law co signed and helped her get a car in her own name.

    The in laws just found out that the couple plans to divorce and the mother in law claims she's going to take the car away, tho our daughter has not missed a payment to Brookline Bank.

    Can the co signer change their mind like this and force return or take away a vehicle?

    Whose name(s) is/are on the title to the vehicle?

    I called her at work and she said the 'title' is still in the name of the bank. She THINKS the registration is in her name only but will check the glove box when she leaves work.

    She is mistaken; the title is not in the bank's name.

    Check again.

    Come to think of it, it may be. She mentioned going over her mileage limit already and a large payment at the end.

    The lessee may appear as the owner on the title, usually with additional entries for the lessors, depending on how car titles work in your state. The title probably does also reflect the lessors' names - your daughter can check, then you can get back to us with the language on the title.
