    Default Buying a Vehicle While a Divorce is Pending

    My question involves a marriage in the state of: MO

    I am in the process of getting divorced. I recently lost my vehicle and need to buy a new one. To avoid losing the vehicle in the divorce, I was going to put it in my girlfriends name. I can get special discounts or services if I cosign on the vehicle because I am a preferred customer at the car lot I am planning on buying from. If I cosign, Is there any way I can lose the vehicle in court?

    Yes.

    Hiding assets from your wife is fraud and can easily be undone by a judge.

    Besides, if you put the car in your girlfriend's name and later break up, she owns the car and you'll be back here asking "what are my rights."

    Anyway, talk to your lawyer.

    It's possible that he can get the judge to order that a car purchase at this point stays your sole and separate property.

    If you are planning on paying cash for the car or putting down a large down payment, then it could be problematic if you are using marital funds to do so. However, if you stipulate to that in the divorce, and clearly accept that as being part of your share of the marital assets, then it should not be a problem. Example: Total marital assets are 100k. You each get 50k. You paid 30k for the car. Your share of the marital assets are the car and 20k of the rest.

    If you are planning to finance the car with a smaller down payment, then as long as you do not attempt to say that the debt on the car is a marital debt, then again, you should be ok.

    It would be stupid to put the car in your girlfriend's name.
