    Default Changing a Child's Name when the Non-Custodial Parent Moves Away

    My question involves name change laws in the State of: FL

    My ex recently moved out of state and gave me 10 days notice. We have a 2 yr old daughter together. I want to change her last name to mine since he is now out of state and won't be dealing with medical and school stuff. What is the likelihood of this happening since he left? Hes refused to changed it in the past but now he left.

    Slim to none, and Slim's hopping the last train out.

    Dad still has rights, no matter how far away he lives, and still has the right to object to any name change.

    are you married? are there siblings?


    A court can allow a name change but they do not generally allow it to be changed such as what you seek. Often times they allow a hyphenated name using both parents surnames. Unless there is a compelling reason to consider changing it to just your name, the odds hover somewhere around 0.

    So let's say his plans fall through and he moves back to Florida next year.

    You gonna petition to change her name back to his? Since he's be back around for school and medical?

    If you go into court and say the only reason why you want her name changed is because he moved, you're going to get shot down.

    No we were never married. Broke up after she was born. I've taken care of her primary/full custody the entire time. He "watches" her as he calls it. I'm fine with hyphenated. She's my child too, I don't see why she can't also have my last name. His excuse is she's my child she will have my last name, well she's my child too. There's a lot more to the situation than y'all know so please do not send nasty comments. I'm just trying to ask for help on answers and opinions.

    You have still not given a good, legal reason to change her name...

    She was your child too when she was born and you named her.

    The two of you agree to a name change.
    There is documented proof of abuse of the child.
    There is a stigma for the child having that last name.
