    Default Background Check Authorization

    My question involves labor and employment law for the state of: Georgia

    Hey guys! This is my first post at the forum, I hope someone could help me out with a question that I had about the meaning of something on my background check authorization. Here's the question:

    "I further authorize the agent of ********** to receive a report concerning the results of the above criminal history records inquiry which were obtained using the Georgia Crime Information Center (GCIC) online network.


    Read the following carefully and answer truthfully.

    Have you EVER been convicted of a crime, paid a fine, forfeited a bond, been sentenced (by a judge) to perform community service, pled nolo contendere (no contest), pled guilty, been given a suspended sentence, or been sentenced to jail or prison time?
    (Include DUIs, but DO NOT include minor traffic offenses, juvenile cases, cases sealed or expunged by a court, or cases completed under the First Offender Act.).
    If the answer is YES to any of the above, list all information requested below. "

    I was arrested a few years ago with a DUI, but it was reduced to a reckless driving and underage possession of alcohol. The breakdown of my sentence is as follows:

    1. Reckless Driving- 12 months probation, 24hours in jail, fees, community service, and a few classes.

    2. Underage Possession of Alcohol- **First Offender** Probation, fees, and community service.

    I don't understand what charges I need to disclose. This is for a potential job, and I want to make sure that I don't do anything that could jeopardize it. Could someone explain this to me? Thanks!!

    There isn't just one question in there. There are many. And they don't all have to do with just "crime."

    Have you ever paid a fine? Yes.

    Have you ever been sentenced to community service? Yes.

    Have you ever pled guilty? Yes.

    Have you ever been sentenced to jail? Yes.

    So, my opinion, the answer is Yes. Then it's up to you if you just want to list the two items exactly as you listed them here:

    1. Reckless Driving- 12 months probation, 24hours in jail, fees, community service, and a few classes.

    2. Underage Possession of Alcohol- **First Offender** Probation, fees, and community service.

    Trust me, everybody looking at those two items will know you got a DUI and you plea bargained for a reduction.

    You're technically being truthful without actually mentioning the DUI arrest because the question doesn't ask what you were arrested for.

    However, a prospective employer might be more impressed with your honesty if you own up to the reason for the arrest rather than the prospective employer figuring out that you are hiding it and wondering what else you are hiding.

    You might not get the job no matter which way you go. It happens.

    Thanks for the reply! I was wondering if I should even mention the UPA, since it says that I don't need to. I have been offered the job already, I just need to fill this paperwork out

    You've been offered the job contingent on the background check. The offer can be rescinded if the prospective employer find something he doesn't like.

    If your background did come up during the interview process.

    My suggestion: Own up to it.
