    Default Division of Equity in the Marital Home After Separation, Lack of Contribution

    My question involves a marriage in the state of: Indiana. I'm concerned about my home. 2 years ago my husband left the house. The only thing he took was his clothes. He didn't help cover the house or any bills. So now 2 years later he desides he wants half the equity from the house. How will that work because he didn't pay a payment or anything after he left?

    You can use the facts to try to convince the court to set a date of valuation that differs from the date of the divorce judgment, or to otherwise make adjustments to the property division to reflect his lack of contribution to the home and its upkeep following separation.

    You and your boyfriend need to use separate accounts because this is confusing. One minute you have an ex wife, now you have an ex husband.

    Not necessarily, but if you have each established separate households and have lived separately for two years, you can argue that the division of property has already occurred and that you should each be awarded the personal property in your own possession. Are we talking about ordinary household goods and furnishings, or are we talking about your ex's premarital assets, his family heirlooms, and the like?

    Nothing like heirloom. Things like saws and snowblower. Things I need for the house. He is living with his sister so he doesn't need them. He wants to fight for them anyway.
