    Default Recovering Child Care Payments Where Child Was Not In Care

    I need some advice, my husband is ordered to pay child support and daycare expenses in Michigan, well he just found out that the child is no longer in daycare and hasn't been for four years now. He has paid over $9,000.00 for daycare. The ex never reported to the court she took her out. Could she get in trouble for collecting that extra money and could he be credited back what he has paid over?

    Does the child support order require that the mother inform the court (or Friend of the Court) if there is a change in the child care expenses?

    The only thing the courts require is that if any changes are made during the period of time the support is in affect, the party that is collecting the money is resposible for any changes.. like if my husbands job changes he is responsible to notify the courts he switched , vice versa

    You have verified this by looking at the actual custody order?

    In the guidelines you are to notify the courts of any changes, besides all that, he and his -ex made an agreement, through the courts, as long as she was in daycare, a portion of the money was for daycare expenses. The friend of the court accepted it, and signed thier agreement.

    She is bound by the terms of the custody order, so it would be advisable to see what it says.

    I recently found a copy of a letter that was sent to the friend of the court back in June of 2002, from my husband stating that he found that his daughter is no longer in daycare and wanted the courts to reduce the portion for daycare from the child support, and they did nothing. Now today the mother is went down there to tell them, but of course she did'nt mention that she's been out for four years, so he sent his own letter out again to have them investigate it all....
