    Default Position Eliminated, but Still Required to Complete Key Old Job Functions

    My question involves labor and employment law for the state of: Michigan.

    I was verbally notified that my position is to be eliminated, at the same time my employer has offered me a completely different position that I am qualified for. At first glance I was "ok" with this as I would still be employed and able to cover my living expenses, as no pay cut was mentioned. As the days have past with no transition to the new position I am hearing talk about having me continue to perform several of my old position's key functions while serving in my new position, which the two are not related. On the surface this appears to me that my employer may be requesting that I perform the work of two positions within the company almost by force of fear tactic by stating my position is being eliminated take this new position or face termination. Do I have a legal stance on this matter? Or is it simply I accept it or wait for termination and unemployment (if eligible). So the secondary issue would I be eligible?

    Your job duties are what your employer says they are.

    What few people seem to understand is that when a job is eliminated, that is a headcount issue and nothing more. It rarely if ever means that the duties no longer need to be performed. You lucked out in that instead of being the person who lowered the headcount, you became the person who got to keep their job, albeit with additional duties. It also sounds as if you could still end up being the person who ends up out in the job market if you don't adjust your attitude a bit.

    As for eligibility, that's a bit too fact specific for a message board.

    It is not attitude but thanks for the read (cbg). I am and always have been a dedicated employee. My current position is 50 - 60 hours a week, the new position is equally a full time job (FTE based). I understand I could have (and can be) the headcount reduction. Decision time, basically work two full time positions for the same money or take my skills elsewhere.
