    Default Illegal Immigrant Marrying or Cohabitating With SSI Recipient

    Sire,

    I'm an illegal alien currently residing in Vermont with my by birth white american US citizen, who is on disability and regularly receives her social security income, medicaid for her chronic diseases. Right now she is my girlfriend and i'm her boyfriend. but since she was willing enough to start a family with me, we decided to obtain our marriage certificate from burlington's local clerk's office a month ago. then i went back to NYC and came back after three weeks with all my belongings.

    However I didn't know that it was illegal for anyone to even visit her for a few days and stay with her, as she claimed last night. she said last night that anytime anyone from vermont's SSI department (or whatever you call it) can come in and bust into the apartment to find out wheather or not somebody is living with her. according to her, at that time either i will be kicked out or she will lose most or some of her social security benifits that she is receiving right now.

    However it's also true that we both are on the extreme verge of getting married to each other and she is even willing enough to do it today, although i am feeling unpreparead and lazy to do it today and will probably do it within three-four days. I have brought for her christmas gifts, a laptop, a desktop computer and myriad other gifts for her to enjoy. I also bought her and her daughter (she is with her foster parents at the moment) expensive gifts from the mall.

    My question is: 1. If, before i have the chance to get married to her, someone from SSI department breaks into our house and find me sleeping with her naked, what are they gonna do? are they gonna kick me out right away or take some or all benifits away from her? i don't mind dealing with the former but in the latter case we will be devastated because my gf and would-be wife would lose all her benifits and she has some chronic diseases and she is somewhat unable to work because of her feet's condition altough she has been given permission to work less than 35 hours a week.

    2. What would happen if i get married to her first and then the people from SSI comes to our apartment and checks to see wheather or not someone is living with her in the government-provided apartment? What exactly would take place then? will i get kicked out or will they take away some or all benifits from her?

    3. Pretty soon after marriage she said she was willing to file an 'adjustment of status' petition for me so that i receive my EAD and other documents because of my marriage to my wife, although these whole marriage based immigration procedures are probably going to take a long time since i don't have enough money to pay for filing, nor does she! and because i don't have legal work permit and the permission to stay legally in the USA.

    4. Here is a little bit of info about me: I entered USA legally on a visitor's visa and my i-94 expired 55 days ago. so there is probably a fair chance of me changing my status from illegal to permanent residence if she really files the petition for me. And this would take a long time. as long as i don't get the permit to work, can i really legally live with her in the government-provided apartment without fear of getting kicked-out?

    If she's lying to them and claiming to be living alone, and collecting benefits based upon a household income which does not include that of her spouse or cohabitant, she could be required to repay the overpayment, her benefits might be terminated, and she could even potentially face a criminal fraud charge. Also, her housing subsidy is likely based on household income and with your living in her home she may lose her eligibility. If she fails to report an increase in household income, she could face a requirement that she repay the improperly obtained subsidy, possible eviction, and again a possible fraud charge (although less likely than with other forms of public assistance).

    Does she have somebody with financial means who would cosponsor you, in association with your marriage and application for adjustment of status? It doesn't sound like she could sponsor you herself, as she lacks the means.

    Perhaps I need to stay in more.
