My question involves a consumer law issue in the State of: California
I purchased a new construction home which closed on March 27, 2015. Some 3 weeks later i, along with 10 other homes in the phase, received a notice of Mechanics Lien notice from a local building supply company for $3,700.00.
Two problems/questions i have with the service:
1) Does the building supplier have to provide me, the new owner with a preliminary lien notice? If they sent the builder such a notice does that apply to me? Nothing of the sort was discovered in the title search.
2) The company filing the mechanics lien lists only "Building Materials" as the product provided. If the function of the mechanics lien to an attempt by the building materials supplier to get me to pay for materials directly, do they not have to be more specific about what was delivered so i may do my own due diligence?
Any advice would be of great help.
