    Post My Son's Ex Girlfriend is Trying Change My Grandchild's Last Name

    laws in the State of: North Carolina
    My son and his now ex girlfriend had a child together two years ago. They have been on again, off again for pretty much the whole time.When they were together, my son lived at her house with her parents. He is listed as the father on the birth certificate, but he never signed it. She has always said she doesn't want child support from him. He helps out, buying diapers, wipes, clothes, etc. And he also gets him whenever he can which is every other weekend and once or twice during week. Now,all of a sudden, she is wanting to change his last name from my son's to hers. Her reason being that since they will never be together as a family she wants the child to have her name. My son is refusing to sign the papers and she said that she could do it without his consent but then it would have to go to court and he would have to pay child support, going all the way back to when their child was born. I guess what I'm asking is what rights does my son have?

    Your son has the right to get on here and ask the questions that pertain to him because there are obviously parts to the story he's not being honest with you about. If he's listed on the child's birth certificate, then he signed the AOP. Have him come on here, create his own account and ask the questions that he'd like that pertain to his child. This is one of the biggest reasons why we don't like to answer questions posed by third parties.

    Ok. We are going to a local attorney tomorrow, but I just thought I would ask. And he's not a liar.

    Then he doesn't understand.

    In order for an unwed father to appear on the birth certificate, he signed the paternity papers.

    Why can't he go to the attorney on his own? Is he a minor?
