    Default California Training Benefits Eligibility

    My question involves unemployment benefits for the state of: California.
    I was wondering if anyone has any experience with California Training Benefits? The reason I am asking is because when I read up about it before I started school, the way I understood is was that I just had to notify EDD before I reached my 16th week of regular UI payment that I was attending school. I started my UI claim on January 4th and started school January 5th. So my 16th week of UI benefits will be April 19th - 25th. So up until the beginning of March I had not marked on my continued claim form that I was attending school (now I am currently marking it on my claim forms and have not been reached by EDD). Well then a couple classmates of mine who had been approved for CTB because of the vocational program we are in told me I should have been marking it the whole time! Now I'm sweating bullets because I'm afraid I will be disqualified for not marking I was going to school this whole time. When I look up info on EDD there is conflicting info, some saying you MUST MARK THE CONT CLAIM FORM THE WEEK YOU START benefits and some I've read that says you must notify EDD before being paid your 16th week of regular UI benefits. Someone please help me. I absolutely cannot lose my benefits!

    Your only, and I do mean ONLY (because you're a cinch to lose your benefits if you have even ignorantly commit fraud) thing to do right now is to call them AT ONCE and let them know you are in school. Discuss this situation with them. You may have screwed yourself up already, because there is a school or training related question on the form you've been using to certify for weeks of benefits. You should have told them immediately when you begun training. And then from then on, you would not have had to mark it, because they would already have had a decision on the or contacted you yet, but they will. Better you contact them first.

    CALL THEM and talk with a living human being. Explain exactly what you have done and when you began training. Don't waste your time sweating bullets and worrying, get it straightened out immediately. First thing tomorrow. They will need to make what is called a "training decision" regarding your eligibility, and then you will not be required to make work searches, etc any more while you are in the approved training. They may have already done so. I can't tell from here. They can by looking at your claim in the system.

    But just because you have been flying under the radar for a few weeks does NOT mean you are protecting your benefits that you "absolutely have to have." They could demand backpay for each week you've gotten since you began school IF you haven't dealt with it appropriately and don't deal with it soon and get it approved and get your claim set up as it should be when you're in training. They don't want to cut you off, they just want you to report things as you need to. If it's okay, aschool claim decision has already been made, and you were not supposed to mark your card "entered training" each time you certify, they'll be happy to explain that to you too. Don't listen to your co workers or co trainees. Get it from the unemployment insurance system. Hold the line till you can talk to someone and get this cleared up.

    I have tried several times to call them and I absolutely cannot get through on the phone. It always says there are too many callers and hangs up on me. I made a honest mistake and I feel very hopeless.

    I am sorry. But if there are too many callers, that means somebody is getting through. So you be the one. Start at 7:00am. Keep trying all day. Right now, this is more important than going to school. Honestly, this is a time that you must get through. If you can't get through on the hotlines, search the departmental directories. Search for the unemployment technical assistance lines, search for alternate numbers everywhere. Get through. You can do something about this, you can get through, and you must. Persist. I know how difficult it is. I have held phones and redialed for four or five hours at a time. But you must find a way to communicate with a living human being about this issue, or what you most fear will come upon you. Don't pretend you just "felt so hopeless" you couldn't do anything about it, and you just didn't understand, and it was an honest mistake and everything else. Do you have a counselor or somebody in your training facility who can help you work to get this situation straightened out? Find them, get to them, and let them help you get with the unemployment system.When we worked with the training facilities, we were in close touch with them. The employment and training section of the unemployment office may be able to get you through to someone. Did you not work with somebody there before you began your training? This is a place where acting helpless is not the thing to do. Get help now.

    I will go straight to the unemployment office tomorrow and see what they can do. What do you think my chances are that they will understand my situation? And thank you for all your help!

    You can get through. It's difficult, but it can be done. I've done it multiple times and there hasn't been one time that I was unable to get through the entire day. I wouldn't call on Monday or Tuesday, but you may want to try on Wednesday. Your other alternative is to log into your EDD account and send them an email. Explain the situation and ask if there is a better phone number in which to call to discuss THIS PARTICULAR ISSUE. CTB benefits very well may have their own specific set of employees in the unit who deal with these issues only and you won't find out if they have their own dedicated phone number unless you get in contact with them.

    I still say call them. Call them early and constantly until you get them. Nice you have a walk in unemployment office. I'd be surprised if you can find anyone in it that will be able to help you. But they may be able to help you get the number to call for the select group that deals specifically with this issue. Ask them.

    Understand your situation? Well, they have seen it all and heard it all many many times before as far as "why I did it." All the way from "I just didn't under staaaannddd!!!!" to "Oh my God I can't, I mean can't just can't oh just can't lose my unemployment benefits and I was soooo scared, soooo scared........." to "The law states on page blah blah blah that I have blah blah blah, and if you do not agree to comply with my interpretations of this law, I will call my uncle, congressman blah blah blah, and we'll have your job.....!" Like I said, unless they are very new, they've heard every approach. They understand all right.

    If by "understand" you mean cut you slack and let you get away with no fault, no penalties, no punishment or determination of fraud, all I will suggest is, be nice, be sincere, be ready to do everything you can do to make this right. Be firm and NOT WHINEY in that you did not understand the correct way you were supposed to report this. Say you want to move forward from here doing everything just right. This is why YOU have to take the trouble and make the effort to reach them, even if you "called a couple of times and couldn't get in" not just let it drag on until they actually catch you. They are much more likely to be forgiving if the person who is working with them is nice, not whiny or belligerent or defensive. They appreciate that you have been the one who took the action to fix this as soon as possible.

    They really don't care why you did it. They just want to get it set right with the least amount of trouble in the least amount of time. Being needy and pitiful is NOT a factor in whether or not you will be penalized. As I said before it is NOT a poverty or needs based program. They don't care if your baby is starving, as it relates to unemployment insurance. They care that the laws are followed, that claimants meet the legal requirements for the program.

    That said, be prepared for a few weeks without benefits while they are making a school decision for your claim. If things go as they should, and you receive the approval to be in school as you should already have had, you should be back paid for any weeks during the decision that your claim has been delayed. But don't whine about this, don't keep calling about the status of your claim, don't try to plead with them that you're destitute and cannot bear any break in the claim. They won't care, and it will only irritate them. You want them on your side, helping you get your claim in good standing so you can get on with your training without having to be hopeless and depressed and worried and agonizing all the time.
