    Default How are Chapter 13 Payments Calculated

    My question involves bankruptcy in the state of: AL

    He filed in 2014 and was immediately able to refinance his home, purchase new vehicles and open a business. He then refused to pay and the chapter 13 case was dismissed. I am one of his debtors, so I have full access to the debtor side of the financials.

    What percentage of income does bankruptcy court in AL calculate for payments?

    Second question, wouldn't refusal to pay as agreed (especially considering the above statement) constitute fraud?

    If the Chapter 13 case was dismissed, the repayment plan is irrelevant.

    Failure to pay a debt is not fraud. If in fact the bankruptcy case has been dismissed, you can take action to collect what is owed to you.
