    Default What is the Likelihood of the Court Approving My Emancipation Request

    My question involves juvenile law in the State of: Oregon

    Hello everyone. I turn 16 in a couple of months and am planning on trying to become emancipated. I reside with my mom and step-father in their home, though we mostly leave each other to do our own things. I have a 3.5 GPA average and I'm also graduating a year early from online school. I have my permit and a car that I pay for gas and insurance for. I also pay for my cell phone bill and my clothing and a lot of the food that I eat. I've had a job for the past 6 months and I earn about $600 a month. I make and go to my doctor/dentist appointments myself and pick up my own medicine from the pharmacy. I have a few friends as well as a girlfriend who would allow me to live with them if I don't find an apartment of my own. I believe that I am mature and responsible enough to handle myself without any sort of parental supervision, but I'm unsure of what exactly I need to prove to the court to make them approve this request when it comes time. Also, does it matter whether or not my parents consent if the court deems me fit of living on my own? Thank you so much, R.

    Extremely unlikley even in Oregon which has perhaps some of the most liberal emancipation guidelines in the country.

    The court is going to want to see that you're self sufficient. Shacking up with your minor girlfriend isn't going to qualify. $600/mo is less than they will typically consider sufficient.
    Your parents are required to be notified in the proceeding and the court will VERY much consider their opinion.

    You seem to labor under the misconception that emancipation is some procedure that allows you to escape parental enslavement. It is not, it is the recognition that an independent youth needs relief from a few statutory things (like the inability to enter into contracts) denied him.

    Even in Oregon, it's virtually guaranteed that $600/month isn't going to cut it.

    What happens if the friends, or the girlfriend, up and leave? What will you do then, OP?

    To answer your other thread, you need permission from both parents if they have joint legal custody.
