My question involves landlord-tenant law in the State of: NY
Landlord accepted deposit from Prospective Tenant to hold apartment for lease signing. Prospective Tenant decides not to sign lease because they were not happy with the language of lease (standard off-the-shelf lease used). Landlord may now lose a month's rent in the process. Does Landlord return deposit to Prospective Tenant? Landlord specifically said that "The deposit will be returned in full if Prospective Tenant is not accepted", but the Landlord did not reject the application. Now Prospective Tenant wants to call Landlord. Do you have any sound advice in this scenario?
