    Default Neglect and Emancipation

    Okay, I have a problem...

I am 17 and Living with my mother has become hell. Her live in boyfriend has caused me problems. She doesnt care for me no more, and no matter how much i tell her to take me to get medical help or that i need to see a doctor, she doesnt care. Isn't that neglect? The stress of her not caring for me but dropping everything for her boyfriend is making my life hell. I believe that if I can get away from her and her boyfriend that I will be better off. I have some questions i would really need help with.

THANK YOU SO MUCH if you could answer my questions or give feed back

#1 In florida, she would have to file the petition. I know that. But what if she doesnt want to? My father lives in Virginia, would he be able to do it?
Your father can initiate proceedings for a change of custody.

#2 If my father is paying child support, if i am granted emancipation would i be able to recieve that money?
Not unless your father voluntarily chooses to pay you the money. Being dependent upon support from your parents is inconsistent with the financial independence typically required before a minor qualifies for emancipation.

#3 I do have a job and I go to school, and im in the process of joining the armed forces (With my mothers signiture). Would this be something the judge would take into consideration?
Becoming an active duty of the armed forces in some states has the effect of emancipating the minor. It has that effect in most cases, given that a new recruit is almost always sent to train in a base in a different state.

#4 If I can get a signed and notarized paper that my father would be providing me with money each month to help besides the income of my job..is that allowed?
You can get any statement you want; however, such a statement would not demonstrate you to be able to financially support yourself independently of your parents.
