My question involves juvenile law in the State of: New Mexico
Hello, this is concerning my granddaughter. My son and his ex were never married and live in two separate households. My granddaughter was in a gifted class at one time in fourth grade when my son had sole custody. Now she is 12. She has run away about four or five times that I know of. She might have been with an older boy those times. She is skipping school. She might be into drugs. She is a very beautiful girl. She is a follower. My son wanted to put her into a therapy day treatment program. The mother who has been in prison will not do anything. She says she will go to the family therapist and at the last minute backs out. My granddaughter is getting more and more out of control. She does not want to go with my son on his days because he disciplines her by taking away her phone or tv etc. My granddaughter is not being taken care of by the mom. The mom does drugs in front of my granddaughter. My granddaugther has told me a lot of things that the mom does but will not tell anybody in court because she does not want her mom to go back to jail.
What can my son do to get my granddaughter help? He feels his hands are tied because the mom lets her do whatever she wants to do and so my granddaughter will not accept any disciplining/visits with my son. Going to court is ridiculous. He already spent thousands of dollars doing that and no matter what, the judge sides with moms. My son has never been in prison, duis, drugs or any of that. THe mom has a long history of police records. My son is supposed to have his daughter 11 days and the mom 6 days. But the granddaughter will not go to my son's house anymore. He cannot force her.
What can he do?
