    Default Police Officer with Charged With DWI

    My question involves criminal law for the state of: North Carolina. I am new to this forum and I hope that I am submitting this question in the right forum. Let me start out my saying that everyone makes mistakes and I understand I made a BIG one so I don't need to be beat down more than I already am. I need someone that will give me advice that is going to help me.

    I had a really great job as a public safety officer. I have worked in the law enforcement field for going on 5 years. I am just going to jump into it....There was a checkpoint on the road to my house. I turned down a side road and the officers came after me. I was charged with DWI and open container for a old mason jar that was in my car. I did not submit to anything SFST's or any other questions. I didn't submit to the breathalyzer which I know I should have but I was just so upset over it all. The officers was able to get a warrant for my blood. I feel that I am gong to be over .08 my court date isn't until May and hard telling when they will get my blood back. I know as far as the stop and not submitting to the breathalyzer I am 90% positive I am going to have to plead guilty unless something technical was messed up on their part such as paperwork. I am not trying to cover up what I did because I know that I was wrong.

    I resigned from my job on my own free will. I havent drank since that night and I am on the right track. I got a job until I can go back to school. I already have a major in psychology and minor in computers. My heart is in Law Enforcement and will always be. I know that I may not ever be able to get back into law enforcement again but I am willing to fight until someone says its impossible. My plan is to put some time behind me and try for it again. Which mean I will have to stay out of trouble, have a clean driving record since the charge and show I am responsible. Most places I know that the time restraint is 5 years.

    Now to the question. In the meantime what should I be doing educational wise? I thought about EMT-Paramedic program which will take 2 years to complete but it will at least be in the professional field and closely related. I may just need to keep a steady job, pay my bills and get time behind me and do BLET over again after 5 years. Just looking for advice from those who have been through it with a positive story. There are plenty of bad stories. I know I will have to prove myself now and I am ready. I was born to do this! It's my heart!

    Any advice would help! Please let me know if I should post in another forum this is my first post!

    It sounds as if you have the proper motivation and plan to overcome your problem. I would encourage you not to ignore any issue you might have with alcohol, and be honest with yourself. If you have a problem, get into a program and stay with it!

    As for retraining, that, too, is a good idea. It will allow you access to a second career, and it will show that you have grown since your incident. You may be able to get back into law enforcement, but, as you know, it will be very difficult. But, additional skills and a career that can show you can still get into the game and keep your head about you is a good plan.

    Keep with whatever you choose to do, stay away from the alcohol, and keep up the positive attitude.

    cdwjava thank you for your honest and kind response. Not only will I be completing the court required classes I believe I am going to start going to meetings on my own just to keep myself in check! As we know alcohol is a lot of cops de-stressor mechanism not a good one but it is. We also know that it can be a career breaker.

    I am a very motivated person and I am going to go for it. I just like to have a plan in action.

    My understanding is that there is now a test that can detect alcohol use within the previous three days or so. It might be possible for you to return to law enforcement after demonstrating a period of recovery and possibly submitting to a testing regimen that would verify your recovery going forward. This would likely be at your own expense. Maybe your old department can implement something like this?
