Absent a contract that states otherwise you are legally free to stop going to work immediately.
Even with such a contract he would be legally free to stop going to work immediately. The most an employer might try to do -- and even this is tricky and possible only in limited circumstances -- is try to get an injunction against the employee's working elsewhere. That sort of step is pretty much limited to sports and entertainment contracts or, in a more limited manner, when the employee's new job is taken in violation of a valid non-compete agreement.
