    Default Can an Infraction Be Raised to a Misdemeanor in California

    I recently was cited for having an open container, and was given an infraction ticket with a court date on it. This isn't my first case of legal trouble however. I have had one Minor in Possession of Alcohol in 2012, and a second one in 2013. The second one ended up getting dismissed. I'm worried that since this infraction is alcohol related that the judge will raise it to a misdemeanor and send me to jail. Can they raise it? Also are there additional charges that can be filed after receiving this ticket? This took place in Davis California

    What code section was cited?

    In general, if you are arraigned on the offense as an infraction, it will remain an infraction.
