    Default Can You Continue to Shop at a Store That Caught You Shoplifting

    My question involves criminal law for the state of: New York

    My friend(18 yrs old,lives in nyc) got caught with about $90-100 worth of stuff. She said they took the stuff and didn't call the cops, take her picture or make her sign anything. She can still shop there and they just wrote her name down. They let her off because she was a college freshman and they didn't want to ruin her record over something like this but made her promise not to steal again. Also they took her address at school just so her parents wouldn't find out and said she'd receive something in the mail.What does that mean? Does she have to pay? How much? I think she'll have to pay a civil demand if anything? Will she have to go to court? What will happen to her? She's been really scared and nervous lately and I feel really bad. Even though there is no excuse, she's still a good person and I think she may be doing this as a result of her depression (I heard that stealing is something that people with depression sometimes do) idk if that makes sense but she normally doesn't act like this. Anyway, thanks for any help.

    You can expect that the "lawyers' for the store will ask for several hundred dollars in compensation for the damages she and her fellow thieves cause them. It is the civil demand.
    If she pays it they won't take her to court over the civil damages. It's independent over whether she is charged criminally or not (which seems that they are not going to pursue).
    Don't make excuses. Depressioon doesn't deprive you of your ability to realize that stealing is WRONG. She may need treatment but it doesn't excuse her moral turpitude.

    To answer your title question: What did they tell her? If they didn't tell her to stay out of the store, then yes she can go back. If she's not sure, call and ask the store.

    Yes, she'll have to pay the civil demand.

    Yes, depression and shoplifting are sometimes tied together; no, that doesn't mean anything, legally speaking, but if she doesn't want to get in further trouble over this, I'd STRONGLY advise she see a psychologist/psychiatrist for the depression.
