    Default Protecting a Child from Neglect by the Custodial Parent

    My question involves a child custody case from the State of: PA. I am in the icu because of other parents neglect on my stepson. Who do I contact to make sure my child is protected asap, she has custody but is unable to care properly for him or we wouldn't be here..

    With the relevant facts being what? What is your spouse doing about the situation? Does the hospital agree that this is a case of child neglect, such that it has fulfilled its obligation to notify protective services of the situation?

    If your husband wishes to petition to modify custody, he would do so through the court that has jurisdiction over the most recent custody order. Depending on the facts, your husband can also notify protective services -- but if your initial claims are correct, as previously indicated, the hospital will already have done that.

    Hospitals have a legal responsibility to report suspected cases of abuses and/or neglect to the authorities. If this hasn't been done, there isn't a case. Have the drs told your husband that the child is their due to neglect of the other parents ? Disagreeing with the way other parents parent their child is not the same as neglect. If your husband agrees with you, has he filed for sole custody ?
