    Default Seeking Dismissal for Lack of Speedy Trial

    My question involves traffic court in the State of: Washington

    I received a speeding ticket and sent in my paperwork to contest. I received my notice of hearing and my pre-hearing conference was scheduled several weeks past the 45 day limit (according to IRLJ 2.6). I filed a motion for Speedy Trial within the prescribed ten days.

    I have not heard back from the court or attorney as of yet and the 45 day window has now passed. I would now like to file a motion for dismissal.

    I have the following questions:
    1. What do I need to say in my motion? (verbiage, citations etc.)
    2. Do I need to submit anything else with the motion, such as supporting information/documents and what do they need to say?
    3. Will the court approve or deny my motion through correspondence or will they send me a date to appear and make a verbal motion?

    Some clever searching on you favorite search engine might produce some sample motions. If you are drafting a written motion you would want to cite the relevant facts, relevant legal authority, and make sure that your motion is in proper form. You would also need to properly serve the motion, file it, and make sure that it's noticed for hearing. I have not found a basic "how to" guide for filing motions for your state.

    In many traffic courts, motions would be heard on the date set for trial. You can ask the court clerk about noticing the motion for an earlier date, and whether the judge is likely to require oral argument.
