    Default Can a Minor Study at a Foreign University

    My question involves juvenile law in the State of: North Carolina

    I'm a 16 year old planning on graduating early next year and then doing a prepatory year of language courses at a university in Belgium. I would be 17 at the time and would be living on my own (likely with other students).

    I was wondering if this is legally viable. My parents would be paying for most of my tuition and living costs. Are minors allowed to study in an institution of higher education in a foreign country while not living with their parents?

    Is a US university sponsoring this program? If so, then you need to be directing your question to them. If this is something that you are arranging independently, then you need to be speaking to the university in Belgium. I do believe your question is a valid one. Its quite possible that you would have to be 18 before this could be possible.

    I'm arranging this independently as I plan on obtaining my full degree from the university in Belgium. While I do believe they would accept a 17 year old (as I'm sure Belgian students have skipped grades or started kindergarden a year earlier and the like) I wanted to make sure that this would be legal to do by US laws before asking about it.

    American parents have sent their minor children to European schools for ages. I can't imagine any legal prohibitions on this.

    Once you have a passport and are out of the US, the only crimes the US can prosecute you for are those committed in a foreign jurisdiction they become aware of, within the limits of Federal law.

    True, there are programs like exchange years and boarding schools that many minors can partake in. The only circumstance that may be different in this case is that I'd be living on my own.

    Would contacting someone from a Belgian consulate or embassy here in the states be a good idea? Perhaps I could ask if there are any age restrictions in acquiring a student visa (which I will have to apply for at a consulate or embassy anyway when the time comes).

    There isn’t anything in U.S. law that prevents you from doing this. If your parents agree to let you go and you’ve got a U.S. passport, from a U.S. law perspective there isn’t a problem. I don’t imagine that Belgium makes this illegal either, but you’d need to check with Belgium authorities if you want to be absolutely sure of that.
