    Default Can Your Supervisor Require That You Disclose an Anxiety Disorder to HR

    My question involves labor and employment law for the state of: California
    I disclosed to my supervisor months ago that I suffer from anxiety. It does not interfere with my work. Recently, another employee asked me to switch a shift so he can play hockey. In doing so, the supervisor butchered the schedule and gave me multiple close/opens. This could have been easily fixed by just switching one day but she refused to do so. I finally had to tell her that the schedule was giving me difficulty re sleep and she then agreed to change the schedule but is now forcing me to disclose the anxiety issue with HR. She already but it in a memo that I just saw on the senior managers desk where everyone can see it. Is it illegal for her to force me to disclose this to HR?

    If you are seeking special accommodation due to a disability, the employer is within their rights to require you put it in writing. They are also permitted to disclose it to other staff as necessary for the business to function.

    Thanks for your response disagreeable. I don't believe I am requesting special accommodation. The schedule before I was kind enough to switch for my coworker was fine. It could have stayed that way had she just flipped another day but she refused to with no reason. It made absolutely no sense. She's obviously intentionally giving me the bad schedule. I was just asking that the schedule be made fair. I've run it past several other employees here and they agree it's horrible but can be fixed so easily. Is that asking for accommodation??

    Any change is asking for accommodation. the question is what kind of accommodation. It appears this manager wants to document your request so it can be recorded as to why it was granted. Most employers would just say no.

    Let's look at it another way.

    It doesn't matter how bad the schedule is or how many people agree it's horrible - she has no legal obligation to change it. She can give you as lousy a schedule as she wants and it's perfectly legal.

    You are the one who said it's causing you medical issues and requested a change. THAT IS A REQUEST FOR AN ACCOMMODATION. You are asking her to accommodate your sleeping issues.

    That's an HR issue, whether you want it to be or not. You don't think it's necessary to take it to HR? Well, she doesn't think it's necessary to change the schedule unless she's accommodating a medical condition.

    Ball's in your court.

    Thanks for your response. The schedule was fine until I did another guy a favor. No good deed goes unpunished.. She simply could have switched another day to make it right. There's allot more to the story that's too much to write. I'm confident if you heard all of it you'd see it differently.

    The legal experts here base their answers on what is posted. If you can't be bothered to provide all the information, then you have to accept the answers given to you.

    If your anxiety is not relevant to your job, then you made a mistake in discussing it with anyone at your job. That was the only way they knew of it, after all. And when you cited it as the reason they should do something for you, you opened yourself to what they have requested. There is no other way to see this any differently than that.
