    Default Grabbing Somebody's Phone When They're Trying to Call 911

    My question involves criminal law for the state of: Louisiana

    Earlier today i was with a girlfriend bringing her to someones house to drop her off and i went inside with her.. The guy got violent and started attacking her. I immediately said im calling the police and tried to go outside he shut the door on me. I walked out anyways went downstairs dialed 911 and said there was a dispute going on .. While talking to the operater he came up behind me and tackled me and took the phone and ran off.. The cops came and spoke with him the girl ran off because she was so out of it. He said if she wanted to press charges to call them. Im wondering Am I able to press charges for him assaulting me while on the phone with 911? and If i do press charges could i get compensation for physical and emotion trauma. also how much would that be? There was another wittness who saw him come up and tackle me as well watching thru the window.. Or Im also wondering if I have to press charges today or if I can press charges a few days from now. Or If I should just speak to the family and settle it out of court. How much should I ask for ? IF you can give me some free advice would def appreciate it very much. Thanks

    What physical and emotional suffering have you been diagnosed with by a medical doctor? Sure you can file a police report for the assault that you suffered.

    Did you not tell the police about the incident when they responded to the scene?

    No I meant the physical and emotion tramua from getting tackled by this guy then he hit me in the back of the head and ran off back at his girlfriend.

    When the police arrived I asked him if i should file a report and he said no that if the girl wants to press charges to call the police and press charges...

    What im wondering though is if I can press charges. And If I have to press charges now or if I can in a few days or not. Also wondering If i do press charges Would he just go to jail or would there also be compensation for him physically attacking me.

    Also I think his mother wanted to speak with me. Im wondering If she trys to offer me cash to not press charges Would that be illegal or not or if it is legal to settle without pressing charges. For a incident such as this Watching him punch her in the face then chase her around and come tackle me while im on the phone with 911 and punch me in the head and take my phone etc . How Much should I tell her I want.

    Basically I hate the guy he is total garbage and either way If i can take there money or put him in jail I would be happy. Either way as well the Girl is done and is staying at another place now. Thanks much for your help

    You might get the police to press charges. I do not foresee any money coming your way.

    If you told the police and they didn't do anything, in their opinion there ws nothing to it. If you didn't tell the police and now you want to, obviously what happened wasn't that bad. Did you receive medical treatmetn at the scene ?Were you transported to the hospital ? What physical injuries were you diagnoised with by the ER dr ? If your answers are no and none, you need to let it go. If the police thought it was serious they would have arrested the man.

    You are free to try to supplement your report to the police. Your delay in making a report is likely to factor into any decision as to whether or not to seek charges.

    If you try to extort money from grandma, it's much more likely that you'll end up behind bars than it is that the other guy will be charged. You will lose any credibility.
