Default Bought a New Car and Don't Want My Old Car Anymore

My question involves vehicle registration laws for the state of: California

Hello, I just bought a new car. This makes me have two cars now.

My old one has serious mechanic problems that make it almost impossible to drive anymore. It still has auto insurance and a valid registration until 01/2016. I'm planned to just keep it in my garage and not use it anymore. After 01/2016, I planned to file PNO on it. Months before 01/2017, a smog check is require on it, that's when I planned to retired my old card because I'm sure it will fail it.

If I decide to remove the auto insurance off of my old car, will it the current registration be suspended? If so, can I still file PNO on it after 01/2016 after the registration has been suspended?

Yes. Your insurance company will notify the DMV of the removal of coverage. The DMV will either suspend the registration or send you notice of pending suspension if you don't provide proof of insurance, and then suspend your registration.

    No.

The registration has to be in effect to file the PNO.

However, there does seem to be a process available to get around that.

First you file an Affidavit of Non-Use. Then remove the insurance. That allows the registration to stay in effect until expiration. Prior to expiration you file the PNO.

I have to tell you this. Keeping a drivable vehicle under those circumstances is an incredible risk. You are bound to drive it "just this once" and when you get caught or have an accident you are 100% f--k-d.

I've read hundreds of posts from people who whine and cry about the consequences of getting caught driving or having an accident without insurance. It's pathetic and it's their own fault for not using any common sense.

I suggest you just sell the car for whatever you can get. If it fails smog before you sell it, then give it to a wrecking yard and be done with it. Don't take the risk of keeping it without insurance.
