    Default Child's Mom is Supposed to Be Randomly Drug Tested but is Not

    My question involves child abuse or neglect in the State of: WV

    My daughter's mother was arrested last year for DUI with her children in the car. She has been going through parenting classes and a sobriety program to get custody back. I didn't have the option of custody because I was about to be deployed, so my daughter (and her little sister) have been staying with my parents. I am getting medically discharged from the Army in 6 months, so I will be able to play a more active role in this situation.

    My ex recently let it slip that she isn't being randomly drug tested, which was supposed to be court ordered. Instead, she calls the testing place every other Friday and goes in to be tested. The case worker has praised her for this saying that she has never had a parent ask to be drug tested.

    My thoughts are.... two weeks is plenty of time to get drugs out of her system. If random drug testing is court ordered, don't they have to keep up on it?

    Nothing in her life has changed in the last 9 months. She's back with her ex husband who is a drug felon and he's financially supporting her. Her brother who has also been arrested for drugs is living with them as well. She hasn't gotten a job to provide for the kids (also court ordered), worked for her G.E.D., done anything besides the parenting classes and sobriety program. She's surrounded by the same type of people as before. But the case worker has recommended that she get the girls back at the end of the school year because she's making so much progress.

    I left a message with the child advocate, but I'm sure they'll just tell me that they're looking into it.

    A real druggie isn't going to be disciplined enough to really time the regular drug tests. A urine test for pot has the best chance of detection at seven days, but heavy users will go substantially longer. Amphetamines and opiates are on a shorter fuse (3-4) days but it would still take a lot of discipline to be taking them and then going cold turkey for four days in advance of the test on a regular basis. The randomness is supposed to give them uncertainty on an INFREQUENTLY administered test. A regular test with almost certain detection is likely to be more likely to discourage use. Sorry, but I think you'll have to invent some other excuse to try to get custody away from her.
