I work at 6am, which means pre-care or dropping off at my ex would result in him waking up at 5:15, to get ready and get out the door.
In the other case, he will have to be ready to get to school at 9am from both houses.
Also, the 9 mile drive is about 15 min door to door. I've timed it.
What happened to what's best for the child?
Yes, that makes it a 30 minute round trip in the morning, and a 30 minute round trip in the late afternoon, for a total of 1 hour a day.
The judge's opinion of what is best for the child will not necessarily be the same as yours or the same as mine.
Mom will certainly be able to demonstrate that its more convenient for everybody for the child to go to school in her district. If I were her I would also make the argument that you could pick up the sleeping child, put him in the car, and then mom could put him back in bed at her house so that he could sleep a while longer, before getting ready for school.
However, the judge may also think that your idea is better, however the judge may make a deviation in child support to take mom's extra costs of transportation into consideration.
Or not...we cannot predict what the judge's opinion will be. However, do not hang your hat on just the fact that the schools are higher rated in your district.
