Ok I really need help in this situation. My boyfriend has 5 years felony probation for identity fraud. He was recently arrested for probation violation for failure to appear. I was somewhat reassured by the fact that he knows he did nothing wrong and that once he or I'm able to talk with the judge(which I'm doubtful on my side will happen) he can get his probation back and be released. After reading threads on here though I'm not so sure and really concerned. What happened is that during his first report with his Dekalb PO he told her that he had moved and so she transferred his probabtion to another county. He became sick and got diagnosed with cancer and hepatits and there are hospital records to prove the fact. On his first visit with his new Fulton PO he repeatidly tried calling her to reschedule because he had a liver biopsy scheduled before that appointment on the same date. He never got any response and talked with his other Hall PO about it and he suggested that he go to his doctor's appointment while he made notations in the state's system of the failure on the part of the other Fulton PO to respond. A few weeks later he recieved a letter giving him a warning and tried to contact her again with no response. He eventually got sicker and was ordered bed rest by his doctor and after still no response from his Fulton PO he decided to go to her office where he found out he had a warrant and that his probation had been transferred back to Dekalb County. Now he has phone records on his cell phone(only registered number in system) of his attempts at calling her and no calls from her. Calls to his Hall PO and the notations. He also has the medicals records of his conditions. I talked with his Dekalb PO about it and she says that he should have called her which is why she placed the warrant. I want to believe all that is good enough but reading that hearsay is acceptable and considering that his probationary period hasnt been that long I don't know anymore. We dont have alot of money and I told him I could find a lawyer for $1,000 but he says it wont be necessary, he'll just use a public defender. He claims the PO is just trying to cover her ass but I'm not convinced they'll believe that.
Questions:
Should I hire a lawyer anyways, and is $1,000 a good price or a scam artist for this case?
Will our case hold up in court?
Will talking with the Judge make any difference? she signed the warrant.
What Should I Do?
