    Default Suit Filed For Credit Card Debt

    A lawyer has filed suit against me for a credit card debt. I have not been served paper yet. I am in Texas. If the do not serve me papers can the law suit go foward?
    I have tried to talk to the firm that is suing me but they do not seem to want to talk about a settlement. What is my best action?

    If they try to serve you and you try to avoid being served, they will probably get a court order permitting substituted service (probably service by posting or publication) and proceed with the case.

    I am not avoiding them I am in the process of moving to another state. Does this matter?
    What is the best way of settling this?

    No. The information above is correct. You obviously know you've been sued, so hiding from the process server won't help you much when the court permits substituted service.

    Contact the plaintiff's law firm and try to negotiate a settlement.

    That is something you dicuss with your own Attorney with credit card company's Attorney.
