    Default Restricted Parking Zone Ticket After Posted Hours in Seattle

    My question involves a traffic citation from the state of: WA

    Hey guys, I got a ticket for parking in Fremont at 11pm. I thought that after the hours posted on the sign, I was free to park. I guess this isn't the case. Can someone confirm that I was not ticketed incorrectly? A picture of a similar sign is below, although mine was from 7am to 8pm Except by Zone 27 Permit



    My ticket says..

    Violation: Restricted Parking Zone
    Section: 11.72.3510A (I can't find this on the Seattle Municipal Code lookup)
    Fine: $53
    NO PARKING 8PM - 12AM
    EXCEPT BY ZONE 27 PERMIT
    NO VALID ZONE 27 PERMIT VISIBLE

    My understanding of the picture of the sign I posted above was that after 6pm, I could freely park there. Is that not the case?

    I believe it's just 11.72.351, that's the restricted parking zone statute.

    According to the Seattle website Zone 27 should be an 8AM-Midnight zone, but google maps show the signs indeed say 7AM-8PM in much of that area. Neither appears to match the citation.
    What's the exact address of the violation?

    3845 Fremont Ave N. I tried pulling it up on Google Maps, but I can't read it. I'm certain that the sign said 8pm. Is this something I might be able to fight?

    On the website (http://www.seattle.gov/transportatio.../rpz_z27.htm):

    When is the Zone in Effect?
    Monday – Saturday 8 AM to Midnight
    (2-hr parking allowed for non-permitted vehicles
    8am-8pm; No parking except by permit from 8pm to midnight)

    The sign clearly says 8am to 8pm. However, there's a sign beneath that is tagged with stickers or something. That sign probably says no parking from 8pm to midnight. Since the sign is not legible, could I fight this?

    If you're going to try to dispute the ticket based on an obscured sign, you're going to need to take a current photograph of the sign. That picture is from last July. Depending on the other signage on the street, you may also want some perspective shots to help demonstrate that without your being able to read the obscured sign it was not reasonable to expect you to know that your parking was not permitted.

    Is there a requirement in that area to install AND maintain signs? If so, the argument could be that the failure to maintain a sign after stickers covered it prevented you from knowing what it said.

    So your citation was outside of the time frame specified on the sign? Is parking outside of the time frame prohibited?

    The signs seem to be posted quite frequently along the street and, as it stands, we have no way of knowing if the sign in the Google Maps photo remains obscured. Hence, see my prior post.

    I was parked outside the time frame specified on the visible sign, but violated the potentially obstructed sign. I'll know more when I visit the sign tomorrow.

    But it appears he was cited with the RPZ violation. A general "no parking" sign doesn't seem to be what he's charged with.

    I checked out the sign this morning. It is indeed covered up.



    I took a video of my approach and can take additional pictures this evening showing various angles before I figure out how to fight this thing. Am I right in assuming I have a good chance of getting this waived?

    I have no faith in administrative parking proceedings, but I would say you have a chance.
