    Default Custodial Parent Not Keeping Up on Medical Needs

    My question involves a child custody case from the State of: New Jersey. My son has varies medical needs that need surgery to be fixed. Not going to go into much detail as it's not needed, but long story short a year later and none of them are corrected. I'm on the birth certificate but I have no legal rights. I know the first step is to file for some sort of custody but at this point I'd like to just file so physical custody. He hasn't had insurance in over a year because she let the state insurance lapse after a year. Every dr visit, hospital visit and medication has been paid out of pocket by myself or with the help of my mother. She has no sense of urgency when it comes to his medical needs, And everytime I call to have his insurance reinstated the company tells me they can't discuss it with me and hangs up on me. As I said I know the first step is to file for custody but I wanted to be sure I had a "solid" case. Sorry as I probably rambled. Thanks in advance

    Is there a reason why you haven't already filed?

    File for joint legal custody, and expect the state to request reimbursement from you (I'm not sure why they haven't, actually).

    Not all states seek reimbursement from the ncp for all benefits. Here in Virginia, they seek reimbursement for tanf but not snap/ebt nor medical. Does New Jersey?

    Benefits established before 2012 can, yes. Since then? No idea. Maybe you can look that up.
