    Default Can a Landlord Apply a Rent Overpayment to Repairs

    Can i keep rent overpayment and apply to damages if deposit does not cover?



    My question involves landlord-tenant law in the State of: NC

    Sorry my 11 month old son hit enter before i was done typing the subject.

    My mother has some tenants who moved out on the 10th. They gave proper notice, although paid the last month in full. There were damages to the property which amounted to more than what the deposit was so she used the overpayment of rent and put it towards that. Is this legal?
