    Default 18-Year-Old Charged With Selling Alcohol to a Minor, First Offense

    My question involves criminal law for the state of: Kentucky

    My 18 year old son sold a malt beverage to a minor in a sting operation while working as a cashier at a local Dollar General store. I know that KRS 244.087 states that an 18 year old may sell alcohol under the supervision of a person at least 20 years of age. At the time my son sold the alcoholic beverage to a minor he was under the supervision of no one, as the other individual working that night was in the stock room. Is it worth attempting to defend the charge selling alcohol to a minor 1st offense on the grounds that no person over the age of 20 was present at the time of the transaction? I am unaware of the fine involved for him or the implications of having such a charge on his record at this early age. Any advice would be greatly appreciated!

    He should hire a lawyer and seek deferred adjudication if available.

    For the future...he should take a TIPS/TAMS class and get that certification.

    I have worked as a Promotional Model...nice way of saying I poured samples of alcoholic beverage in stores while looking pretty.

    Company policy: Card EVERYONE. We took down names. We had a check list of what items we were demoing, and what 3 items they sampled.

    Why? Dram Shop Laws. Why write down their names and check what they sampled? Aside from marketing reasons, it also showed that I did indeed card the person, and they had 3 samples of the specific size poured through a measure pour sput into a measured mini cup.

    I once had a sampling session at the beginning of college season. I was also seeing foreign and out of state ID's. Learned to read those to verify birthdate and age. I had two liquors with pops to mix samples of...yikes. But you know what? In 18 months of doing that job....I never served a minor I won't say I never got sworn at by adults, I won't say I never heard "I left my ID in the car, but I'm 34"...."No ID, no sample". I even carded my own mother, seriously.

    Your son needs to learn....when behind a counter with tobacco or booze....he needs to think of himself....

    Dram Shop Laws: See, your son sells to the minor. The minor gets into a car crash. The minor now sues your son, the store, and others....
